Terms
Terms & Conditions
Overview
These terms apply to all design, consultation, and construction services provided by Rutherford Landscapes. Engagement of our services confirms acceptance of these terms.
Design & Scope
While the design provides a clear framework, we recognise that landscapes evolve on site. We are happy to refine and adjust elements during construction where appropriate, to improve the outcome or respond to site conditions.
Variations & Adjustments
Adjustments during construction are a normal part of the process. Any major changes to scope, materials, or design will be discussed and confirmed with the client. Where adjustments result in additional cost or time outside the budget windows, this will be communicated clearly before proceeding. Smaller refinements are part of our normal design-and-build process. These are managed on site by Dan as the work develops, allowing the project to remain seamless, efficient, and true to the overall design intent. That’s one of the joys of having the designer regularly on site each week, the decisions are seamless and streamlined.
Pricing & Payment
Pricing is provided in cost windows, once the design is sufficiently resolved. Payment terms are outlined within each project agreement and are typically staged in line with project progress. A deposit must be paid prior to commencement of any work. Payment terms are strictly seven days from invoice date.
Site Conditions
Our work is based on visible and known site conditions at the time of design and pricing. Unforeseen conditions—such as subsoil variation, buried services, or structural constraints—may require adjustments to scope, methodology, or cost.
Construction & Programme
Timeframes are indicative and may be influenced by weather, site conditions, and material availability.
Materials & Planting
Materials and plant selections are specified to suit the design intent and site conditions.
Where availability changes, suitable alternatives may be proposed. Planting is a living system and will establish and evolve over time. We rely on you to care for the garden plantings when we are not on site.
Consents & Approvals
Where required, council consents remain the responsibility of the client unless otherwise agreed. We can assist with documentation and coordination as part of the design process.
Maintenance
Ongoing maintenance is the responsibility of the client unless a maintenance programme is arranged. The long-term performance of the landscape depends on appropriate care.
Health & Safety
All work is carried out in accordance with New Zealand health and safety requirements. Site access during construction is managed to ensure safety.
Liability
We take care in the delivery of our services. Liability is limited to the value of the services provided, to the extent permitted by New Zealand law.
Photography
We may photograph completed projects for portfolio and marketing use, unless otherwise agreed.
Governing Law
These terms are governed by the laws of New Zealand.
